Word mark vs device mark: A word mark covers the name in any font or colour — broader protection. A device mark protects a specific logo. If you have a logo, filing both separately is advisable.
Class description matters: This defines the scope of your trademark's protection. Overly broad descriptions may be objected to; overly narrow ones leave gaps. See the Trademark Classes guide.
Proposed to be used vs used: You can file before commercial use begins. If the mark is already in use, state the date of first use and attach a User Affidavit — this strengthens your application and establishes priority from the earlier date.

Key decisions when filling Form TM-A

Fee category
₹4,500 vs ₹9,000 per class
The concessional ₹4,500 rate (online) applies to individuals, startups recognised under DPIIT, and MSME-registered entities. Companies that do not qualify must pay ₹9,000 per class. The MSME registration certificate must be uploaded as an attachment at the time of filing to claim the lower rate.
Single vs multi-class
One TM-A or multiple?
A single TM-A application can cover multiple classes, with a separate fee for each class. If your brand is used across different categories — e.g., a restaurant and a packaged food brand — filing for both classes in one application is efficient. Each class gets its own examination and its own registration certificate.
Mark category
Word, device, or composite
A word mark covers the name in any font or colour. A device mark covers a specific logo. A composite mark covers both combined. Filing a word mark separately from a device mark gives broader, more flexible protection — the word is protected regardless of how it is styled.
Address for service
Where TM Registry sends notices
All official correspondence from the Trade Marks Registry — examination reports, opposition notices, renewal reminders — goes to the address for service stated in the application. If you have an advocate, their address is used. Missing a notice because an address was wrong is a common and avoidable reason applications lapse.

Frequently asked questions about Form TM-A

Form TM-A is the official application form for registering a trademark in India under Section 18(1) of the Trade Marks Act, 1999. It is filed with the Trade Marks Registry and covers the applicant's details, the mark, the class of goods or services, and a verification statement. A single TM-A application can cover multiple classes, with a separate fee for each class.
The official government fee is ₹4,500 per class (online) for individuals, startups, and small enterprises, and ₹9,000 per class for companies and other entities. Filing offline costs ₹5,000 and ₹10,000 respectively. Professional/advocate fees are separate from the government fee.
A small enterprise application is filed at the concessional fee of ₹4,500 per class by entities registered as MSME under the MSME Development Act, 2006, or recognised startups under DPIIT. The MSME or startup certificate must be uploaded with the TM-A application. Companies that do not qualify as MSME or startup must pay ₹9,000 per class.
Jurisdiction is determined by the applicant's principal place of business in India. There are five Trade Marks Registry offices: Mumbai (Maharashtra, MP, Goa), Delhi (Delhi, UP, Rajasthan, Punjab, Haryana), Chennai (Tamil Nadu, Kerala, Karnataka, AP, Telangana), Ahmedabad (Gujarat), and Kolkata (West Bengal, Bihar, Odisha, North East). If the applicant has no business in India, the address for service determines jurisdiction.
A trademark can be filed before it is put to commercial use — this is called a "proposed to be used" application. It is completely valid under the Trade Marks Act, 1999. Filing early secures your priority date. However, if the mark is never used after registration, non-use for five continuous years can be a ground for removal under Section 47.
